Terms of Service
These Terms of Service ("Terms") form a binding agreement between you and YellowMint Technology (Malaysian company registration number CA0396372-K, registered in Ipoh, Perak, Malaysia; "we", "us", "YM POS") governing your use of the YM POS service.
By creating an account, accepting an invitation as staff, or placing an order through a storefront powered by YM POS, you agree to these Terms.
1. The service
YM POS provides:
- A QR-order storefront for each shop at
/{shop-slug}. - A shop-operator dashboard for menu, order, staff, and loyalty management.
- Payment QR code generation for PayNow (Singapore) and Touch'n Go eWallet (Malaysia).
YM POS is not a payment processor. PayNow and TNG transactions move funds bank-to-bank between the customer and the shop operator's nominated account. We generate the QR code that initiates the transaction but we do not handle, route, hold, or settle funds. The shop operator is the merchant of record for all payments.
2. Eligibility and accounts
- You must be at least 18 years old to register as a shop operator.
- One account per natural person.
- You are responsible for keeping your sign-in credentials secure and for all activity under your account.
- You are responsible for the staff you invite, the permissions you grant them, and their actions within your shop.
3. Beta status
YM POS is offered as a public beta at the date of these Terms. While in beta:
- The service is provided AS IS and AS AVAILABLE, without warranties of any kind, express or implied.
- Features may change, break, or be removed.
- The service is free of platform fees. We will give you at least 30 days' notice before introducing paid tiers; any data you have created will be preserved.
- We may discontinue the service in whole or in part with reasonable notice except in urgent security or legal cases.
4. Operator responsibilities
If you operate a shop on YM POS, you are solely responsible for:
- The accuracy of menu items, prices, tax labels, modifiers, and stock availability.
- Compliance with all food and beverage, health, hygiene, licensing, and consumer protection laws applicable to your business.
- Fulfilment of orders placed through your storefront, including handling complaints, refunds, and disputes.
- Configuring the correct PayNow proxy or TNG account for your shop. A mis-configured payment QR may direct customer payments to the wrong account; we are not liable for such errors.
- Compliance with applicable data protection laws (including the Personal Data Protection Act 2010 (Malaysia) and any other jurisdiction where you operate) in respect of your customers' data, for which you are the data controller.
5. Customer responsibilities
If you place orders through a YM POS storefront, you agree:
- To pay for goods you order, using the payment method shown at checkout.
- Not to abuse or attempt to overload any storefront.
- Not to reverse-engineer, scrape, or attempt to gain unauthorised access to YM POS systems.
6. Acceptable use
You agree not to use YM POS to:
- Sell goods or services that are unlawful in Malaysia or in the customer's jurisdiction.
- Harass, defraud, or impersonate any person.
- Distribute malware, spam, or unsolicited communications via web push notifications.
- Circumvent any security or access-control mechanism.
- Scrape, crawl, or otherwise extract data from storefronts or dashboards without our written permission.
7. Payments
- All transactions on YM POS are settled bank-to-bank via PayNow (SG) or TNG (MY). YM POS is not a money services business; we do not hold customer funds at any point.
- The shop operator is the merchant of record and is solely responsible for tax invoicing, refunds, chargebacks, and dispute resolution.
- We do not charge customers any payment processing fee; any fees imposed by the customer's bank or wallet provider are governed by that provider's terms.
8. Intellectual property
- You retain ownership of your menu content, item photos, logo, branding, and customer data ("Operator Content").
- You grant us a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, and display Operator Content as necessary to provide the service.
- We own the YM POS platform, software, design system, and documentation. We grant you a non-exclusive, non-transferable licence to use the service in accordance with these Terms.
9. Termination
- You may close your shop and delete your account at any time via the dashboard. Order records may be retained as described in our Privacy Policy.
- We may suspend or terminate your access to the service for breach of these Terms with reasonable notice, or immediately in urgent security or legal cases.
10. Disclaimers and limitation of liability
To the maximum extent permitted by Malaysian law:
- The service is provided AS IS and AS AVAILABLE without warranty of merchantability, fitness for a particular purpose, or non-infringement.
- We are not liable for any indirect, incidental, consequential, special, or exemplary damages, including loss of profits, revenue, data, or goodwill, arising out of or related to your use of the service.
- Our total cumulative liability to you for any claim arising out of or related to these Terms or the service is capped at the total fees you have paid to us in the twelve months preceding the claim — which during the beta period is zero.
- Nothing in these Terms limits any statutory rights or remedies that cannot be excluded or limited under Malaysian law (including the Consumer Protection Act 1999 where applicable), and nothing limits liability for gross negligence, wilful misconduct, or fraud.
11. Governing law and jurisdiction
These Terms are governed by the laws of Malaysia. You and we submit to the non-exclusive jurisdiction of the courts of Malaysia for any dispute arising out of or related to these Terms.
12. Changes to these Terms
We may revise these Terms from time to time. For material changes we will give signed-in operators at least 30 days' notice via an in-app banner. Your continued use of the service after the notice period constitutes acceptance.
